Scottish Government 2014-15 NDR update

The following three pieces of Business Rates legislation were laid in the Scottish Parliament on Thursday 6 February and apply from 1 April 2014.

  • SSI 2014/28 - THE NON-DOMESTIC RATE (SCOTLAND) ORDER 2014

    The purpose of this Order is to set business rate poundage of 47.1 pence in Scotland for 2014-15. This is the same rate as will apply in England.

  • SSI 2014/30 -THE NON-DOMESTIC RATES (LEVYING) (SCOTLAND) REGULATIONS 2014.

    These regulations make provision from 1 April 2014, for the Small Business Bonus Scheme (SBBS) for two years (2014-15 and 2015-16) and increases the upper SBBS rateable value cap for multiple premises from £25,000 to £35,000. All other thresholds remain the same.

    In addition, the regulations will remove payday lenders from eligibility for the Small Business Bonus Scheme. 

    These Regulations also provide for a poundage supplement in 2014-15 of 1.1 pence on larger business properties with a rateable value in excess of £35,000.

  • SSI 2014/31 - THE NON-DOMESTIC RATING (UNOCCUPIED PROPERTY) (SCOTLAND) AMENDMENT REGULATIONS 2014.

    The purpose of these regulations is to extend the scope of the Fresh Start Relief to support occupation of certain long term empty properties and to remove payday lenders from eligibility for that relief. The upper rateable value limit for eligible premises will increase from £45,000 to £65,000 from 1 April 2014 and on the same date the category of eligible premises will be extended to include those previously used as hotels, pubs and restaurants. The level of relief offered will remain at 50% for the first year of occupation.

    Business Rates Incentivisation Scheme (BRIS)

    The 2012-13 BRIS targets are currently under review following receipt of the 2012-13 business rates audited returns.   

    Once we have the full analysis and the likely impact on non-domestic rate income we will discuss with COSLA and agree revised 2012-13 targets. 

    Summary

    From 1 April 2014, the 2014-15 poundage rate will be set at 47.1p with a supplement of 1.1p for 2014-15 for property with a rateable value over £35,000. 

    The SBBS upper threshold for multiple premises increases to £35,000 and all thresholds are set for 2 years (2014-15 and 2015-16).

    Fresh Start threshold increases to £65,000 and eligible property types have been expanded to include hotels, pubs and restaurants.

    Payday lenders cannot be awarded either SBBS or Fresh start

All other business rate reliefs, aside from the changes set out above, remain unchanged for 2014-15.
