London Borough of Tower Hamlets (18 010 517)
Summary: Ms X complains about the way the Council has dealt with her business rates debt. The Ombudsman will not investigate this complaint because the matter has been determined by a court.
Summary: Mr X complains about the way the Council has assessed his entitlement to council tax support. The Ombudsman will not investigate this complaint because there will be a right of appeal against any decision of the Council to a Valuation Tribunal. Durham County Council (18 018 484)
Summary: The Ombudsman will not investigate Mr X’s complaint about how the Council handled his personal data. The complaint is made late and is also a matter for the Information Commissioner’s Office. Tewkesbury Borough Council (18 018 655)
Summary: Mr X complained that his new council tax support claim did not cover the period when he changed address and claimed universal credit. The Ombudsman should not investigate this complaint. This is because Mr X could appeal against the Council’s decision on his claim to the Valuation Tribunal which is the proper authority to consider these matters. Lewes District Council (18 018 657)
Summary: Mrs X complained about the Council’s failure to allow her empty property discount following the departure of her tenant. The Ombudsman should not investigate this complaint. This is because it was reasonable for Mrs X to appeal to the Valuation Tribunal about the empty rate discount. Dover District Council (18 018 879)
Summary: The Ombudsman will not investigate Ms X’s complaint about council tax liability as Ms X could have appealed to the Valuation Tribunal about this. The complaint is therefore outside the Ombudsman’s legal remit. London Borough of Wandsworth (18 018 982)
Summary: Mrs X complained about the Council recovering an overpayment of housing benefit which it placed on her housing rent account. The Ombudsman should not investigate this complaint. This is because it was reasonable for Mrs X to appeal to the independent benefits tribunal which is the proper authority to consider challenges to benefit decisions. London Borough of Lambeth (18 011 343)
Summary: Ms G complained the Council mismanaged the council tax account for her property resulting in unnecessary enforcement action. The Council was at fault when it misadvised Ms G and failed to take appropriate action when she informed it of changes to the property. The Council has already apologised and written off the legal fees associated with the enforcement action. It will also make Ms G and her sister a financial payment to remedy the distress its actions caused them. Watford Borough Council (18 018 093)
Summary: The Ombudsman cannot investigate this complaint about the Council refusing to award Council Tax relief whilst major works were being undertaken at a property. This is because the complainant has already used his right of appeal to the Valuation Tribunal to challenge the Council’s decision. London Borough of Camden (18 018 402)
Summary: The Ombudsman will not investigate this complaint about a dispute over National Non-Domestic Rates for a period in 2011 to 2013. Part of the issue has been decided by a court and it is too late to investigate other issues. Wycombe District Council (18 017 997)
Summary: The Ombudsman will not investigate Mr B’s complaint about liability for unpaid Business Improvement District (BID) payments and the involvement of Enforcement Agents. The Ombudsman cannot investigate a complaint about whether Mr B is liable for the BID payments and further consideration of the complaint about the Council’s actions in recovering the debt is unlikely to find fault. London Borough of Wandsworth (18 018 302)
Summary: Mr X complains about delay by the Council in dealing with his appeal. The Ombudsman will not investigate this complaint because the matter has been dealt with by the Council and Mr X could complain again if the delay has caused a significant injustice. Kingston upon Hull City Council (18 018 351)
Summary: The Ombudsman will not investigate this complaint about housing benefit and council tax from 2014. This is because it is a late complaint and because there were appeal rights the complainant could have used. Charnwood Borough Council (18 018 472)
Summary: Mr X complains that the Council has illegally sought to recover a council tax debt from him. The Ombudsman will not investigate this complaint because this has can be challenged in the courts.
