This government response summarises the feedback received in response to the public consultation on the draft subsidy control statutory guidance, and also explains how this feedback was used to make improvements to the draft guidance. The responses received provided input into the UK subsidy control statutory guidance.

The Subsidy Control Act 2022 provides a new framework for the provision of subsidies within the United Kingdom which will build on the provisions in the subsidy control chapters of the Trade and Co-operation Agreement, which have applied in the interim of the UK’s exit from the EU.
The aim of the guidance is to explain the provisions of the Act and help public authorities navigate the new Subsidy Control regime. It will provide advice to help public authorities to develop subsidies and subsidy schemes that are appropriate, well-designed, and in compliance with the Act. It will also support subsidy recipients and wider stakeholders to understand the new requirements.
The purpose of this consultation is to seek views on the form and content of the guidance to inform the final version that will be published ahead of implementation of the regime.
