A weekly update on benefits and taxation decisions |
||||
Please note: our decisions are published six weeks after they are issued to councils, care providers and the person who has made the complaint. The cases below reflect the caselaw and guidance available at the time of issue and the individual circumstances of each case. City of Bradford Metropolitan District Council (23 003 293)
Summary: We will not investigate this complaint about Council tax reduction because he can appeal to a tribunal. London Borough of Southwark (23 006 235)
Summary: We will not investigate Mr X’s complaint about the Council’s decision to recover a housing benefit overpayment and its suspension of his benefits. This is because it was reasonable to expect Mr X to appeal and because he did appeal. Birmingham City Council (23 005 578)
Summary: We will not investigate this complaint about a housing benefit overpayment because he can appeal to a tribunal. Gateshead Metropolitan Borough Council (23 005 807)
Summary: We will not investigate this complaint about payment of housing benefit as the matter has been remedied. Herefordshire Council (23 006 185)
Summary: We will not investigate Ms X’s complaint about the Council’s decision to bill her for council tax on her deceased parents’ property. That is because it is reasonable for Ms X to appeal to the Valuation Tribunal. We will also not investigate Ms X’s complaint about the Council’s complaint handling. It is not a good use of public resources to investigate how the Council dealt with Ms X’s complaint. Kirklees Metropolitan Borough Council (23 004 990)
Summary: We will not investigate this complaint about COVID-19-related business grants. Much of the complaint is late, without good reason to accept it now. It is more appropriate for the courts to decide whether Mrs X should receive the compensation she seeks. Reigate & Banstead Borough Council (23 005 215)
Summary: We will not investigate this complaint about delay in determining housing benefit because there is no evidence of fault by the Council. London Borough of Southwark (22 015 845)
Summary: We will not investigate Ms X’s complaint about the Council’s decision to suspend her housing benefit. This is because there is not enough evidence of fault by the Council.
Summary: We will not investigate this complaint about the Council failing to send Miss X reminders and final notices regarding council tax arrears and that the Council failed to send her email notifications of correspondence to read in her online council tax account. This is because the claimed fault has not caused Miss X significant injustice. In addition, an investigation would not lead to a different outcome.
