The Committee scrutinised the above regulations at its most recent meeting on 4 March. At that meeting, the Committee gave careful consideration to whether or not it should take formal reference of the regulations under the statutory procedures. However Committee Members concluded that SSAC’s recent report on the Housing Benefit (Habitual Residence) Amendment Regulations 2014 (published in November 2014) dealt with similar and related issues and that it was unlikely that any significant amount of additional evidence would be gleaned from further public consultation at this stage. Instead, the Committee concluded that it would set out its views in a letter to the Secretary of State for Work and Pensions.
The exchange of correspondence between Paul Gray (SSAC Chair) and the Rt Hon Iain Duncan Smith can be read here: https://www.gov.uk/government/publications/universal-credit-entitlement-of-eea-nationals
