Update on Applications for Relief from NHS Trusts
The latest position, as conveyed to the Institute this morning (29 January), is as follows:-
General Line: We are aware of this issue but that it is for local government to decide applications, based on the facts of each case and we have no current plans to issue any guidance.
NNDR1 Line: Decisions on the completion of the NNDR1 form are a matter for individual local authorities. Our view is that if an authority has already made a decision to give relief they should include it in their NNDR1 (in Part 2 under mandatory relief) but If they haven’t made that decision, (i.e. because they are still considering their position, they should not include it). However such decisions are for individual authorities
The Institute's advice last week was to acknowledge any applications for mandatory relief but to defer awarding of relief until a view had been expressed by the DCLG. The Local Government Association are seeking counsels opinion on this matter and at the present time, the Institute is of the view billing authorities should continue to acknowledge applications but not to award relief. Once we have further information, it will be shared with forum members.
